Terms of Service

1. Acceptance of Terms

By accessing or using EstateEngine ("the Service", "we", "our", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including free trial users and paid subscribers.

2. Description of Service

EstateEngine is a SaaS platform that provides AI-powered Instagram engagement tools for real estate professionals. The platform connects to your Instagram Business account, uses GPT-4o to conduct natural conversations with potential leads, qualifies those leads using AI scoring, and sends alerts when qualified prospects are identified.

3. Account Registration

To use EstateEngine, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials. You must promptly notify us of any unauthorized use of your account at contact@getestateengine.com.

You must be at least 18 years old and authorized to conduct business to create an account. By registering, you confirm this.

4. Instagram Account Requirements

Connecting your Instagram account requires:

• An Instagram Business or Creator account
• A connected Facebook Page
• Your express authorization via Meta's OAuth flow

You are responsible for ensuring your use of the Instagram integration complies with Meta's Terms of Service and Advertising Policies. EstateEngine is not responsible for account restrictions imposed by Meta for policy violations.

5. Acceptable Use

You agree NOT to use EstateEngine to:

• Send spam, unsolicited commercial messages, or harass users
• Engage in fraudulent, deceptive, or misleading communications
• Violate any applicable laws or regulations
• Infringe intellectual property rights of any third party
• Circumvent rate limits, subscription limits, or security controls
• Reverse engineer, decompile, or disassemble any part of the Service
• Resell or sublicense access to the Service without written permission
• Use the Service for any purpose other than legitimate business operations

6. AI-Generated Content Disclaimer

EstateEngine uses OpenAI GPT-4o to generate responses on your behalf. While we design the system to be accurate and professional, AI-generated content may occasionally contain errors or inaccuracies. You acknowledge that:

• All AI responses sent to leads are done so in your name and on your behalf
• You are responsible for monitoring and reviewing AI conversations
• You are liable for any representations made by the AI agent acting as your agent
• EstateEngine does not guarantee the accuracy of property recommendations or lead scores

7. Subscriptions and Billing

Trial

New accounts receive a 14-day free trial with a limit of 100 AI conversations and 10 property listings. At the end of the trial period, the account is paused until you upgrade.

Paid Plans

Paid subscriptions are billed monthly via Stripe. Subscriptions auto-renew unless cancelled. You can cancel at any time from the billing settings; cancellations take effect at the end of the current billing period. No refunds are provided for partial months.

Price Changes

We reserve the right to change pricing with 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.

8. Data and Privacy

Your use of EstateEngine is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.

9. Intellectual Property

EstateEngine and its content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of all data you upload (properties, lead data). You grant us a limited license to process this data solely to provide the Service to you.

10. Service Availability

We aim for high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or experience outages. We will provide reasonable notice for planned downtime where possible.

11. Limitation of Liability

To the maximum extent permitted by law, EstateEngine shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business, or goodwill, arising from your use of the Service.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the three months preceding the claim.

12. Termination

We may suspend or terminate your account for violation of these Terms, non-payment, or any reason with 30 days' notice. In cases of serious violation (e.g., spam, fraud, illegal activity), termination may be immediate without notice.

You may delete your account at any time. Upon deletion, your data will be removed per our data retention policy described in the Privacy Policy.

13. Governing Law

These Terms are governed by the laws of the United Arab Emirates. Any disputes shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

14. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
